For Home Sales Terms & Conditions
Please read these terms carefully, as it is important that you understand our contractual relationship. Any order placed by the buyer, whether orally, in writing or via the Online Ordering Platform, shall constitute a binding contract of sale once the seller has accepted it. Placement of an order or applying for a credit account with OilMaxx will be deemed to accept these terms and conditions and our Privacy Policy and acknowledgment by the Buyer that any fuel supplied will be used for domestic heating purposes only.
1. Interpretation
The Seller means OilMaxx, and the Buyer means the person, firm, or company to whom the Seller agrees to supply Products (the Goods, under the terms thereof).
The Buyer’s acceptance of the delivery of the products will be deemed to be acceptance of all the Conditions. No variation of these Conditions shall have effect unless agreed in writing between the Buyer and Seller.
2. Prices
a) OilMaxx continuously purchases fuel throughout the day; therefore, a quoted price may change within that day due to fluctuations in the oil market. Once the price is received, the buyer must order at that specific point to ensure you receive that price for your order. OilMaxx will deliver all orders at the price indicated at the time of acceptance of the Buyer’s order.
b) All prices quoted via the Website Online Ordering platform will be secured at the point of order after payment has been processed and the order accepted.
c) All prices quoted are only applicable for a 2-hour period. OilMaxx cannot quote for deliveries beyond this point.
3. Payment
An order will only be accepted by OilMaxx once payment has been made.
Payment terms are cleared funds only by either credit/debit card at the time of order, and such payment will be in GBP sterling.
Delivery cannot be made until payment has been authorised and OilMaxx has received cleared funds.
If the customer orders more fuel than the tank can hold, credits may be issued if;
a) The delivery is more than 500 litres
b) A £10.00 administration fee may be charged due to the customer overestimating the volume of oil required.
4. Quantity
The seller’s measurements of quantity shall be accepted in all cases by the Buyer. The fuel delivery will be made through a Trading Standards-approved delivery meter, and will be accepted by the Buyer.
Once delivery has been made, the seller cannot accept any responsibility whatsoever for any discrepancies in the buyer’s tanks, dip rods, or other measuring devices.
5. Delivery
a) Refusal to Deliver
The Seller reserves the right not to be able to arrange deliveries when the Buyer may expect, for reasons of health and safety, environmental, site access, product availability, weather conditions, or a backlog of orders.
If the Seller cannot access the site with a 6-wheeler tanker, the Seller reserves the right to refuse delivery.
b) Passing of Property and Risk to Buyer
In deliveries, the risk and property in the goods will pass to the Buyer at the Seller’s permanent hose coupling.
c) Safety
The Buyer undertakes to provide a safe walking area around the storage area and the Fill point and ensure there is appropriate and adequate storage to enable the full quantity ordered to be delivered into the Buyer’s storage. Prompt and safe passage for the Seller’s vehicles between the public roadway and the actual point of unloading will be provided by the Buyer, who will indemnify the Seller against any damages, claims, costs or expenses whatsoever arising from the presence of the Seller’s vehicles in the Buyer’s premises. Seller shall not be responsible for any loss whatsoever suffered by the Buyer as a result of a breach of these conditions.
d) Environmental
The buyer shall maintain and ensure storage tanks and associated equipment are installed to legal requirements and that such tanks do not become the cause of environmental pollution of any kind by reason of such tanks or equipment leaking or spilling in any way. In the event that such environmental pollution is caused by leakage or spillage from the Buyer’s tanks or equipment, the Buyer shall be responsible for clean up to the standard required by the relevant statutory authority. The Buyer hereby indemnifies the Seller against any costs, fines or expenses of any kind incurred by the Seller as a result of the Buyer’s tank or equipment.
e) Unattended Deliveries
The Seller will not accept any responsibility whatsoever for any measurement queries or any alleged spillages if the delivery is unattended.
f) Contamination
The Seller only supplies kerosene. If the Buyer orders Kerosene and, in fact, the Buyer’s requirements are for another product, then the Buyer indemnifies the Seller against any claims or expenses incurred as a result of the contamination.
6. Right for the Customer to Cancel the Order
The Customer may cancel the Order for the Goods they order at any time up to the end of the seventh working day from the date the Customer has requested delivery of the ordered Goods. You do not need to give OilMaxx any reason for cancelling your order, but OilMaxx reserves the right to request a reason for its own records.
The Customer will be charged a £10 administration fee for all orders cancelled.
No orders may be cancelled once delivery of the fuel has taken place.
To cancel the Order, the Customer must notify OilMaxx in writing.
Once the Customer has notified OilMaxx that they are cancelling the Order, any sum debited to OilMaxx from the Customer’s credit/debit card will be re-credited to the Customer’s OilMaxx account as soon as possible and, in any event, within 30 days of the Order, PROVIDED THAT the cancellation has been made in accordance with these terms and conditions.
7. Cancellation By Us
Oilfast reserves the right to cancel the Order if:
- It has insufficient stock to deliver the Goods ordered;
- It does not deliver to the Customer’s area; or
- One or more of the Goods ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by OilMaxx from its suppliers.
OilMaxx may suspend, vary or terminate the Order immediately without notice if the Customer breaches any of its obligations under any of these conditions.
If OilMaxx cancels the order, the customer will be notified by e-mail. It will re-credit to the Customer’s account any sum deducted by it from the Customer’s credit/debit card as soon as possible, but in any event within 30 days of the Order. OilMaxx will not be obliged to offer any additional compensation for disappointment or losses suffered.
8. Weekend Urgent 1 Day Deliveries
All Emergency One-Day Weekend Orders must allow one working day to process.
If the customer places an Emergency One-Day Weekend Order on a Saturday or Sunday, the delivery will be scheduled for the following Tuesday.
This allows the Emergency One-Day Weekend Order to be processed on the next working day, which in this case would be Monday.
All orders placed on Bank Holidays will be processed on the next working day.
9. Vouchers
All vouchers are one-time use and valid for a limited time only. Only one voucher can be used per order or transaction.

Definitions:
When the following words are used with capital letters in these Service Terms, this is what they mean:
- We, Us, Our: OilMaxx Ltd
- You, User, They/Their: Customer
- Budget Payment Plan: Contracted Monthly Payment Plan
- Direct Debit: Contracted Variable Direct Debit
- Device: A monitoring device that allows us to monitor your oil levels.
- Automatic Top-Up Service: We arrange a Top-Up schedule and deliver your fuel. As part of this service, we monitor your fuel levels, but we don’t guarantee that you will never run out of fuel.
- Service: The oil monitoring, Budget Payment Plan, and Automatic Top-Up Service that we are providing to you as set out in these Service Terms.
1. Free Budget Payment Plan:
The User agrees to a monthly payment plan based on an estimated annual usage provided to Us by the User. The User agrees to pay for their first order and delivery up-front in a lump-sum payment. The User understands that after this initial order and delivery payment, subsequent payments will be taken on the chosen date every month via Direct Debit. Payments will be required to be made even in months where no fuel is delivered. The User must clear any outstanding balance on the Annual Anniversary of their Budget Payment Plan if they have used more than the estimated amount.
2. Device: Remote Tank Level Monitor:
FREE Telemetry Hardware worth £150 (exc VAT) and free installation worth £50. This lets us see your tank level to organise a delivery at a predetermined level ensuring complete peace of mind that we guarantee that we will never let you run out of fuel.
The device remains the property of OilMaxx and is provided on loan. OilMaxx have the right to remove the equipment at any time.
3. Free Remote Monitoring:
The monthly fee valued at £6.00 (VAT inc), will be waived while you remain on budget payment.
The User wishes to receive fuel deliveries without contacting us to place an order for fuel. The User understands that we will only deliver if it is safe to do so, depending on delivery conditions. The User acknowledges that upon receipt of a sales invoice and delivery ticket confirming the quantity delivered and amount due, the value will be debited from their account. The User agrees that deliveries will continue until the user cancels the service. This service is contingent to joining our Budget Payment Plan to pay, Variable Direct Debit.
4. Automatic Top-Up Service:
We monitor the User’s oil levels and deliver fuel to four agreed scheduled frequencies –Summer / Winter / Spring & Autumn. PLEASE BE AWARE WE DO NOT GUARANTEE THAT YOU WILL NEVER RUN OUT ON THIS SERVICE. PLEASE OPT FOR OIL MONITORING / TELEMETRY, OPTION 2, instead to ensure this level of service.
The User wishes to receive fuel deliveries without contacting us to place an order for fuel. The User understands that we will only deliver if it is safe to do so, depending on delivery conditions. The User acknowledges that upon receipt of a sales invoice and delivery ticket confirming the quantity delivered and amount due, they will pay the sales invoice in line with the payment terms on their credit account with Us. The User agrees that their Top-Ups will continue unless either party provides two weeks’ notice in writing to the other party. To pay for this service is contingent on joining our Budget Payment Plan, Variable Direct Debit Contract.
5. Data Signal:
The device’s installation is subject to Dual SIM with CATM & NBIOT availability at the installation location. If none of these networks allow coverage, we clearly must forgo installation and revert to manual top-up.
6. Direct Debit T & Cs:
- Acceptance into this monthly payment system is entirely at the discretion of Oilfast Limited.
- To use the system, you must hold an account with a UK bank which operates a direct debit system.
- OilMaxx Limited reserves the right to refuse delivery if any direct debit payments fail to be collected.
- If you decide to leave Oilfast Limited, you should inform us by email to ([email protected]) or by letter to Oilfast Limited, Nethan Street, Motherwell, ML1 3TF. We will look at your OilMaxx account and attendance, and your payments will be calculated up to the date of leaving. If monies are still owed, then the outstanding sum will be taken in one payment by DD. If Oilfast owes you money, then a refund for any overpayment will be credited back to you.
7. Damage to Device:
- You, or a third party, must not interfere with or obstruct the Device. If you or a third party damages the Device, you will be liable for the full £150 (exc VAT) replacement and/or repair costs. If an engineer is required to visit your property after installation, our call-out rate of £30 per hour will apply.
- If the Device becomes defective, out with third party damage detailed above, we will repair or replace the Device at no cost to you.
8. Technical Support:
In the event of a technical issue with the Device, please get in touch with Head Office on 01698 537 152 / [email protected].
9. Responsibilities:
If you are moving house, you must notify us immediately so that we can remove the Device or contact the new homeowner.
10. Cancellation:
- To cancel this Service, we require 2 weeks’ notice from you. This can be done at any time. We reserve the right to charge any outstanding balance on the account.
- If you do not purchase all fuel deliveries from us, we reserve the right to remove the Device and/or cancel the Services.
- We may amend these T&Cs by giving 30 days’ written notice. If we amend the T&Cs, you may cancel the Service with 30 days’ written notice
11. Data Protection:
Oilfast Limited and our Sister Divisions respect your right to privacy. All parties are fully GDPR compliant. We will share your information only within GDPR guidelines with the Device Manufacturer to ensure the Device is working according to the Manufacturer’s specifications and standards.
